Access NJ LLC., a New Jersey Limited Liability Company, respects your privacy and is committed to protecting it through our compliance with this policy.  This policy describes:

  • The types of information we may collect or that you may provide when you create an Access NJ account or use Access NJ system and related services.

  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies only to information we collect:

  • When you register for an Access NJ account.

  • Individuals’ information provided by you.

  • In email, text, and other electronic communications sent through the Platform.

Access NJ works with several service providers to perform essential functions as part of our operations.  Information is shared with these third parties only to the extent necessary for us to process your requested services, like individual exclusion search.

We may make changes to this Privacy Policy from time to time.  We may do this for a variety of reasons including to reflect changes in or requirements of the law, new features, or changes in business practices.  The most recent version of this Privacy Policy will be posted on our website https://www.accessnj.com, and you should regularly check for the most recent version.  The most recent version is the version that applies.  If the changes include material changes that affect your rights or obligations, or materially changes to how we treat your Personal Information (as defined below), we will notify you in advance of the changes by reasonable means, which could include notification via email.  If you continue to use our service after the changes become effective, then you agree to the revised Privacy Policy.  Any revised Privacy Policy will apply both to information we already have about you at the time of the change, and any Personal Information created or received after the change takes effect.  To the extent that any applicable law or regulation requires modification of this Privacy Policy to achieve compliance with such laws or regulations, the Privacy Policy shall be deemed modified to the extent necessary to achieve compliance with such laws or regulations.

We collect information about you and your company and individuals you have access to their information:

  • Directly from you when you provide it to us.

  • From third-party public information (State and Federal Public Databases).

When you setup and account to use our services, we may ask you to provide information by which you may be personally identified, including:

  • Your company contact information, such as your name, email address, mailing address, telephone number.

  • Information about your employees, contractors such as name, date of birth, current address.

Generally, we use information that we collect about your company or that you provide to us to:

  • Fulfill any purpose for which you provide it. For example, run automated exclusion search on your behalf.

  • Operate, develop, provide, and improve our website and its contents, and to research and develop new services.

  • Provide you with notices (i) about your account, (ii) when updates to the services are available, and (iii) of changes to the services.

  • Carry out our obligations and enforce our rights arising from any contracts entered between you and Access NJ or any other user, including for billing and collection.

  • Contact you if there is a problem completing a service you requested or to discuss a problem with your account.

We will NOT be contacting or soliciting any of the individuals you provided the personally identifiable information for, such as your company’s employees and contractor.

The usage information we collect helps us to improve our services and to deliver a better and more personalized experience. We may use location information we collect to identify areas to advertise, or ways promote our service offering, and for other business reasons.

Disclosure of Your Information

We may disclose the Information that we collect or that you provide:

  • With your consent.

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To respond to your request for customer service.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Access NJ’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Access NJ about users of the services is among the assets transferred.

  • For any other purpose disclosed by us when you provide the information.

Rest assured that we do not sell, trade, rent, or otherwise disclose your or your employees/contractors information to third parties for any marketing or promotional purposes.

Your Choices About Our Collection, and Use of Your Information

We strive to provide you with choices regarding Your Personal Information.  This section describes mechanisms we provide for you to control certain uses and disclosures of your information.

  • Tracking Technologies. You can choose whether or not to allow our website to collect information through tracking technologies such as browser cookies.

  • Promotion by Access NJ. If you do not want us to use your email address to promote our own products or services, you can always opt-out by unsubscribe from our newsletter and marketing communication or by sending us an email to admin@accessnj.com.  However, even if you opt out of receiving such communications, we retain the right to send you non-marketing communications (such as emails about your account, changes to the services, Terms of Use or this Privacy Policy).

Your Privacy Rights

This Privacy Policy may not constitute your entire set of privacy rights, as these may also vary from state to state.  To be certain of your privacy rights, you may wish to contact the appropriate agency in your state that is charged with overseeing privacy rights of consumers. 

Data Security

We have implemented measures designed to secure Your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure.  All information you provide to us is stored on our secure servers behind firewalls. 

Our retention period for periodic reports is based on business needs and legal requirements. Retention periods can go up to but not limited to 2 years.

We will securely destroy your active records (aka. Employees/contractors information) from our database once your contractual agreement is terminated (i.e., canceled subscription, default on monthly payment…etc). 

Communications from Us

When you register on our system, you will receive emails that confirm specific actions you requested. These are transactional notifications that you cannot opt out of receiving, as they are in place to protect the security of your account and your personal information.  We will also send you responses to any emails you send us.  From time to time, we will also send user surveys and requests for user feedback regarding user experience and Platform operations.  The completion of these surveys or requests for feedback is strictly voluntary.  If you do not wish to receive these surveys or user feedback e-mails, you may opt out by following the unsubscribe instructions located at the bottom of each email communication.
